The company EVERGLOW, SAS registered with the Périgueux Trade and Companies Register under number 900 524 497, with its headquarters located at 4 Impasse des Brandes, 24 430 Marsac sur l’Isle (hereinafter “RunnrZ” or “we”) operates the RunnrZ application (hereinafter “the Application”). This Application allows any individual (hereinafter “the User(s)” or “you”) to find a route (running, walking, or cycling) around their location.

A User under the age of 15 (fifteen) must obtain the consent of their legal representative for RunnrZ to process their personal data; otherwise, they will not be able to access the Application.

This Privacy Policy provides you with all the information you need to know about the processing of your personal data (hereinafter referred to as “Data”) by RunnrZ. Indeed, the use of the Application requires the processing of certain personal data.

For reference, personal data is any data that allows you to be identified directly or indirectly by combining various pieces of information.

RunnrZ is the data controller, meaning that we determine the purposes and means of processing your data through our Application. The person in charge of data at RunnrZ can be contacted by email at contact@runnrz.app.

In case of difficulty exercising your rights or for any complaint regarding the processing of your personal data, you have the right to file a complaint with the CNIL (National Commission on Informatics and Liberty)

Our Commitments Regarding the Processing of Your Data

Personal data must be processed lawfully, fairly, and transparently. It is our responsibility to provide you with clear and accessible information about how we use the Data we collect.

RunnrZ is committed to complying with all obligations regarding the processing of your personal data under Law No. 78-17 of January 6, 1978, on data processing, data files, and individual freedoms, as amended by Regulation 2016/679 of April 27, 2016, on the protection of individuals with regard to the processing of personal data and the free movement of such data (GDPR). We only collect data that is strictly necessary for the purposes for which we process it. Some data is essential for providing you with access to the Application, including the data required during your registration. Other data may be provided optionally from your Profile page. We have implemented relevant technical and organizational measures, taking into account the state of knowledge and the nature of the Data processed, to ensure their confidentiality and integrity, and we have only used subcontractors based in the European Union for hosting and maintaining the Application.

Why does RunnrZ collect personal data?

We process your personal data for the following purposes :

  • Use of the Application: Registration, offering a suitable route, tracking your performance through your route history, calculating the calories burned during your activity;
  • Emergency Contact: Sending an SMS to the emergency contact in case the SOS button is activated;
  • Sending Promotional Messages Related to the Application: Newsletters related to RunnrZ Application updates and physical activity.

  1. The processing of your Data is based on the following legal grounds, depending on its purpose:
  • The performance of a contract when you accept the general terms and conditions of use of RunnrZ to use the Application; or
  • Your consent regarding geolocation and access to your device’s Health application; or
  • RunnrZ’s legitimate interest.

In this case (promotional messages and newsletters when addressed to RunnrZ Users for similar services), RunnrZ has ensured the strict necessity of the collected data in light of its legitimate interest. Thus, RunnrZ has balanced the rights and interests involved and verified that its interests do not create an imbalance to the detriment of the rights and interests of the individuals whose data is processed.

What data does RunnrZ collect?

We process different types of data depending on the purposes pursued:

  • Identification data: name, first name, email address, password, date of birth, gender for registration on the Application;
  • Your geolocation to suggest nearby routes;
  • Your level in the chosen activity to offer a suitable route;
  • Your weight and height to calculate the calories burned during your route. However, this data is stored exclusively on your device, and we do not have access to it at any time;
  • Identification data of the emergency contact in case the SOS button is activated: name, first name, phone number;
  • The routes you have completed (location, date, duration/distance, terrain, difficulty level, calories burned) to allow you to track the progress of your performance;
  • Your photo and phone number if you choose to complete your profile.
Among these data, only geolocation and the data requested during registration are essential for accessing the Application.

Who are the recipients of your data?

The processed data is intended for RunnrZ and its IT service providers as subcontractors for the hosting and maintenance of the Application. Your personal data is never shared with any commercial partners, whether for free or for a fee. RunnrZ is committed to selecting subcontractors located within the European Union and ensuring they provide all necessary guarantees for personal data protection. Therefore, your data is never transferred outside the European Union.

How is the security of your data ensured?

RunnrZ has implemented the necessary technical and organizational measures, considering the nature of the data processed, to ensure its security and confidentiality. For registration to be effective, the User must validate their email address, and the chosen password must be sufficiently robust and is not stored by RunnrZ. Similarly, data related to the User’s weight and height is only stored on the User’s device. The User is informed that any unauthorized access or attempts to access a computer system, by any means, constitutes offenses under and punishable by Articles 323-1 to 323-7 of the French Penal Code.

How long is your data retained ?

Data is retained in an active database as long as the User’s account is active. This data is then archived for 5 years from the deletion of the User’s account. Data required to establish proof of a right or contract or to comply with a legal obligation will be retained for the period stipulated by the applicable law.

How can you exercise your rights regarding your data?

You have the right to access, rectify, delete, and port your personal data. You also have the right to object to and limit the processing of your data. These rights can be exercised by simply requesting them at contact@runnrz.app. When the collection is based on consent, you can withdraw it at any time by disabling the geolocation on your phone and any access to your phone’s Health application. Regarding data collected based on legitimate interest (newsletters, promotional messages for similar services), you can object to the processing of your data for this purpose at any time by clicking on the link provided in the email or SMS you received, or by requesting it from RunnrZ by writing to: contact@runnrz.app. In accordance with Article 40-1-II of the French Law n°78-17 of January 6, 1978, as amended, relating to data protection and privacy, any individual can provide RunnrZ with directives regarding the retention, deletion, and communication of their personal data after their death at the following address: contact@runnrz.app.
